DUI in a national park is a Class B misdemeanor under the Code of Federal Regulations.

It carries serious penalties, including:

  • Up to 6 months in federal prison
  • Up to $5,000 in fines
  • A maximum of 5 years of probation

If DUI occurred on National Park Service land, the driver will be prosecuted for a federal crime under the Code of Federal Regulations. If it took place on other federal property, the driver will be prosecuted under state DUI laws. According to the National Park Service, drivers commit the offense of DUI when driving under the influence of alcohol and/or drugs, the driver is rendered the driver incapable of safe operation; or the driver has a blood alcohol concentration (BAC) of .10% or more; or the BAC exceeds the limit established under state law if that limit is more restrictive.
