Proving Intent to Sell
When you are facing drug sales charges, there are two parts to your case. First, the prosecution must be able to prove you were in physical possession of drugs when arrested. If you were not in physical possession of said drugs, they must be able to prove you were in constructive possession.
This means drugs were found on your property and you:
- Knew the drugs were on your property
- Had the ability to control said drugs
The second element of your charge is the intent to sell. The prosecution must be able to prove that you were selling or had the intent to sell the drugs.
